Terms of Service

These Terms of Service ("Terms") govern your use of Realty AI, operated by Realty AI LLC, a Florida limited liability company ("Company," "we," "us," or "our"). By creating an account or using our service, you agree to be bound by these Terms. If you do not agree, do not use Realty AI.

1. Service Description

Realty AI is an AI-powered customer relationship management (CRM) platform designed for licensed real estate professionals in the United States. The service includes contact management, deal tracking, property organization, email and SMS communication tools, AI-assisted lead scoring, automated follow-up suggestions, campaign management, document handling, and analytics.

2. Account Terms

• You must be at least 18 years old and a licensed or authorized real estate professional to use Realty AI.
• Each account is for a single individual agent. Account sharing is not permitted.
• You are responsible for maintaining the security of your account credentials. You are liable for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account and keep it up to date.

3. Subscription and Payment

• Realty AI costs $149 per month, billed monthly. All features are included at a single price with no tiers or hidden fees.
• New accounts receive a 14-day free trial. No credit card is required to start the trial.
• Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused time within a billing cycle.
• We reserve the right to change pricing with 30 days' written notice. Price changes will take effect at the start of your next billing cycle after the notice period.

4. Acceptable Use

When using Realty AI, you agree not to:

• Use our SMS or email features to send unsolicited bulk messages, spam, or any communication that violates the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any other applicable law.
• Send text messages to contacts who have not provided proper consent to receive messages from you.
• Upload, store, or transmit any content that is illegal, fraudulent, defamatory, harassing, or that infringes on any third party's rights.
• Attempt to gain unauthorized access to our systems, other users' accounts, or any data not intended for you.
• Use the platform for any purpose other than legitimate real estate business activities.
• Resell, sublicense, or redistribute access to Realty AI without our written consent.
• Reverse engineer, decompile, or attempt to extract the source code of Realty AI.

We reserve the right to suspend or terminate accounts that violate these policies.

5. AI Features and Disclaimer

Realty AI uses artificial intelligence to provide features such as lead scoring, follow-up suggestions, conversation analysis, and automated content generation. You acknowledge and agree that:

• AI output is suggestive, not authoritative. All AI-generated content, scores, recommendations, and analyses are provided as suggestions to assist your professional judgment. They are not a substitute for your own expertise.
• AI does not provide legal, financial, or tax advice. Nothing generated by our AI features should be construed as legal counsel, financial guidance, property valuation, or tax advice. Always consult qualified professionals for these matters.
• AI may produce errors. While we work to make our AI features accurate and useful, they can produce incorrect, incomplete, or outdated information. You are responsible for reviewing and verifying all AI-generated content before using it.
• You are responsible for AI-generated messages. If you choose to send AI-drafted emails, text messages, or other communications to your contacts, you are fully responsible for the content of those messages.

6. Your Data

You own your data. All contacts, deals, property information, communications, documents, and other content you upload or create within Realty AI remains your property.

• We process your data solely to provide, maintain, and improve the service as described in our Privacy Policy.
• You may export your data at any time through the platform's export features.
• Upon account deletion, we will remove your data from our active systems within 30 days, as detailed in our Privacy Policy.
• You grant us a limited, non-exclusive license to process your data as necessary to operate the service. This license terminates when you delete your account.

7. Third-Party Services

Realty AI integrates with third-party services including Gmail, Microsoft Outlook, Twilio, Stripe, and DocuSign. Your use of these integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service. Connecting a third-party account to Realty AI means you authorize us to access and transmit data through that service as needed to operate the features you enable.

8. SMS and Telephony Compliance

Realty AI provides tools to send and receive text messages and make calls through Twilio. By using these features, you represent and warrant that:

• You have obtained proper prior express written consent from each contact before sending them text messages, as required by the TCPA and applicable state laws.
• You will honor all opt-out requests promptly and maintain accurate records of consent.
• You will not use our communication tools for telemarketing to numbers on the National Do Not Call Registry without an established business relationship or prior express consent.
• You are solely responsible for ensuring your use of SMS and calling features complies with all applicable federal, state, and local laws.

9. Intellectual Property

Realty AI, including its design, code, AI models, branding, and documentation, is the intellectual property of Realty AI LLC. These Terms do not grant you any right to use our trademarks, logos, or brand elements. All rights not expressly granted in these Terms are reserved.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• Realty AI is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not warrant that the service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
• In no event shall Realty AI LLC, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the service.
• Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Realty AI LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the service, your violation of these Terms, or your violation of any law or third-party rights, including TCPA claims resulting from your use of our SMS features.

12. Termination

• You may close your account at any time through the platform settings or by contacting us at support@realtyai.app.
• We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent or abusive behavior, or fail to pay your subscription after reasonable notice.
• Upon termination, your right to access the service ends immediately. We will retain your data for 30 days following termination, during which you may request an export. After 30 days, your data will be permanently deleted.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the platform at least 15 days before the changes take effect. Your continued use of Realty AI after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your account before they take effect.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions. Any disputes arising under or in connection with these Terms shall be resolved in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Realty AI LLC regarding your use of Realty AI. They supersede any prior agreements or understandings, whether written or oral.
